FEDERAL COURT SIDES WITH GRASSROOTS ACTIVISTS: RNC DELEGATES ARE BOUND TO FOLLOW ELECTION RESULTS

Delegates Remain Committed to Donald J. Trump; Anti-Trump Effort Dealt Crippling Blow

(New York) July 11, 2016 – Senior United States District Judge Robert E. Payne today ruled in favor of Trump campaign delegates who had argued – in line with overwhelming public opinion – that RNC delegates must follow election results and that delegates cannot be stolen at the national convention. Delegate Beau Correll, Jr., had brought the suit against the Commonwealth of Virginia hoping to reject the will of the voters, but was soundly defeated.

Specifically, the Court found that RNC Rule 16, which binds delegates based on their election results, “is in effect presently and that it controls the allocation and binding of delegates as to their voting at convention.” (p. 6) The Court held that the Plaintiff’s “expert testimony” from Erling ‘Curly’ Haugland was not credible, lacked “textual support,” (p.6) and that “delegates are bound by RNC Rule 16.” (p. 7)

Further, the Court found that by signing the “Declaration and Statement of Qualification,” RNC delegates are bound by RNC Rule 16(c)(2) (p. 10), and that this Declaration obligated Correll to vote in accordance with Republican Party rules and Virginia’s election results. (p. 46)

Trump Campaign Attorney and former FEC Chairman Don McGahn issued the following statement: "The court has confirmed what we have said all along: Rule 16 is in effect and thus delegates, including Correll, are bound to vote in accordance with the election results. The court did not buy what Curly Haugland was selling, and noted that his testimony has no support in the rule's text and was contradicted by his own book, Unbound. This case puts his unbound theory to rest, and is a fatal blow to the Anti-Trump agitators.”

“Huckabee said that there will be hell to pay for going against Trump. Senators who go against them will regret it.”

Gee, doesn’t that sound just like Valerie Jarrett? Disgusting.

Delegates who refuse to vote for the candidate their state won are free to resign.

There is no right of conscience in a political party.

If you don’t like the choice you have, leave! You have no business forcing your opinion upon the party.

Especially when you’re in the minority.

Here’s more “Summer of Chaos” fun for you:

FYI, below is the text of an email that I received. Please feel free to copy and paste it - and forward it to everyone you know:

Please forward this to anyone that you know who lives, works or is planning to be in or near the cities listed below on Friday.
What appears below the line is taken directly from a webpage (cited at the end) – anyone may agree or disagree with the editorial comments – just take the warning about where NOT to be very seriously.

There’s a war in America right now. Black vs. white. Citizen vs. police officer. Race grievances have become an industry, and business is booming.

The rage is boiling over across the nation. First, videos emerged that showed the graphic deaths of two black men at the hands of police, with what appears to be no reason. Protests erupted over these deaths, and then they became violent as one man shot 11 police officers and 2 citizens at a rally in Dallas, Texas, killing 5. That sparked a war on law enforcement officers and a nationwide spree of violence against cops. Some people are even more extreme, declaring open season on white people in general.

But it’s about to get even worse.

The hacktivist group Anonymous is now calling for nationwide Day of Rage protests on Friday, July 15th. The video below promotes the protests.(WARNING: There is some disturbing and graphic violence in this video):

https://www.youtube.com/watch?v=uEWtsSffvQg [About 5 ½ minutes; it isn’t necessary to watch it for purposes of the warning being given].

While I firmly believe that we are being distracted and manipulated so that we stop paying attention to the machinations and corruption of presidential hopeful Hillary Clinton, the fact remains that being anywhere near these protests greatly increases the chance that you could become a victim of violence. When the mob mentality takes over, normally decent people can commit heinous acts.

Use this as a list of places NOT to be on Friday the 15th. While the video by Anonymous does specify non-violence and denounces the actions taken against police officers that were not involved in these deaths, with the tagline “Day of Rage” I think it’s safe to expect emotions to be running very high on both sides of the line. No matter how great your empathy might be for those who have unjustly lost their lives, these protests are not safe places to be.

These are the locations and times for the protests:

I strongly feel it won’t end with people marching and chanting.

The safest crowd is one that you’re not in. All of these places have the strong potential to become battle zones. Stay home.

And if your home happens to be in or near one of these areas, be aware that your city could be under siege. Make plans to stay safe and hunker down with emergency food and purified water, or to go someplace safer.

Stay safe, friends.

“Of course, if they did that they would be writing the obituary of the Party, but the convention would have the power to do this. There will probably be some drama over this issue, but I expect that the rule will not change and therefore the delegates must vote as instructed for the first ballot.”

That’s the Curly Haugland argument.

The rules were set at the 2012 convention for the following 4 years. EVERYONE knew those rules during the primary season and, as of right this second, those rules are STILL in effect. For the convention to change them next week would be to change the rules in the middle of the game - which the court just said is impermissible.

THIS convention will set the rules for the next one, as it has always been. Note that this makes sense, as there are pretty good odds that someone nominated will be the POTUS, and he/his people should have a big say in how the next convention is run.

re:”There have been news stories popping up that this delegate from Virginia was free to vote for whomever he wanted and not support Trump on the first vote.”

That is what I heard earlier this morning. ON two different “news” stations. One in Denver (KNUS) hosted by a NeverTrump Repubican, who was chitting himself, he was so happy.
The other (KTAR) on a usually reliable news site in Phoenix.
Both reported the judge unbound the delegates.
That then prompted me to make an ass of myself with a post condemning the ruling.

Now this news prompts me to question, which report is correct?

Paul Manafort is firmly in charge here and delivering results.

Manafort is being paid $1 as a salary for his efforts which means he is being rewarded on performance. If Trump wins, Paul will make huge amounts from access.

In any case, this non story about the delegates was misreported all over the news this morning which prompted Trump to post that they had won resoundingly in court.

Basically, if the delegates refuse to vote for Trump on the first ballot the votes are counted anyway whether the delegates vote for him or not.

The Federal judge ruled that this was the case.

This is a non story like when the media was saying for weeks on end that the brokered convention was a certainty. Then it evaporated. By the start of the convention, this delegate bs will have evaporated.

These courts seem oblivious to the fact that the trouble makers are Cruz supporters, and RINO supporters, who are serving in the position of Trump’s *Earned* Delegates, at the National Convention.

Trump is seriously mis-represented, with Cruzers serving as TRUMP delegates.

These delegates think they have clout at their party Convention, because it is true, it is a private party and they were the ones who showed up at their neighborhood precinct meetings and county conventions, and were elected as delegates to their state conventions, and to National.

Trump supporters were home mowing the lawn. This bothers me a lot.

I will be glad when the thing is over. In my district in Texas, there were 77 Cruz supporters and 3 Trump supporters at the State Convention.

Trump supporters could not even get nominated, let alone elected, as a National delegate. By the book, it was a fair vote because TRUMP supporters did not participate in the steps of the process.

They do have clout but in this case they have seriously overestimated their influence. I know several Cruz delegates from VA who are savvy and are liking seeing the direction Trump has been going in and they are not liking the NeverTrump crowd. There will be resistance in the VA delegation to this movement because to make a switch in the convention will be disastrous at this point as Trump’s numbers are improving rapidly. This was a talk radio topic this morning.
