I sure hope Texas tells the Feds to back off... unfortunately TX has become rather a pushover of late.
(Remember the "border crisis" a while back? Or very recent the USSC decision that was essentially "we don't like you having any restrictions at all on abortion!"?)

That's assuming a police officer was not cross with them at the time of the arrest, and that a prosecuting attorney does not run afoul of the 39th penumbra of the nine emanation at some point during the case.
