Does he believe they DID NOT KNOW it was illegal to be careless and negligent with classified material?
Exactly. Of course there was intent. They were aware of the laws and regulations regarding classified. No on, NO ONE gets access without briefings and periodic retraining. So they knew the regs, and they knowingly and willingly violated them. The whole “no intent” thing, in addition to being a lie, is irrelevant. Intent or not, laws were broken! Are the laws going to be enforced here or not? Can I go drive a new car off the lot without paying for it - as long as I claim there was no intent to steal it, that I was just going to park it in my garage for them in case it hailed or something? Is that now a viable legal defense that is consequence free?
“Intent” was established by conducting government business on her private servers in an attempt to escape FOIA laws.
The intent is evident in the fact that she set up an outside server in the first place. Why else would she have done so? She obviously intended to evade the policies of the State Department and the federal law.
