Proof of what? That his father never opted to become a naturalized US citizen? Literally hundreds of thousands of people live legally in the United States as permanent legal residents, and there is no law that requires them to apply for citizenship. Some do and some don't.
If they were here illegally, there would be a paper trail. Just like the paper trail that was found in his mother became a citizen.
The absence of any evidence is pretty damning.
