At what point was Michael Brown “in police custody”? If he had been the “hands up, don’t shoot” would be more of a myth than it already is. This makes it sound like he was restrained, and then executed.
Brown was not in custody. He was fresh from a strong arm robbery and attacking a police officer, presumably with intent to murder since Brown had made and attempt to take the officer’s pistol.
