Herein lies the problem with the judiciary. Both Bushes and Reagan selected conservative justices like Antonin Scalia and Samuel Alito to the Supreme Court, but also moderates like Sandra O'Connor and David Souter. Democratic Presidents, from Lyndon Johnson to Barack Obama, almost exclusively appoint liberals. Ultimately, we must overturn not only the decisions of the Roberts, Burger, and Warren Supreme Courts, but the very concept of judicial review of Congressional legislation or state legislation. This precedent was set some 200 years ago with Marbury v. Madison. Until the Congress limits the authority of the Federal courts, we will suffer the effects of judges legislating from the bench, a bad idea even if conservatives were to dominate the courts.
