Cruz Eligible? He ISN'T:

Rafael Edward Cruz, born in Calgary Alberta Canada, in 1970.

Father: Rafael Bienvenido Cruz, did not become a naturalized U.S. citizen himself until 2005.

Mother: Eleanor Elizabeth Darragh Wilson Cruz, became a naturalized Canadian citizen prior to the birth of her son Ted.

Which creates a definite problem for Senator Cruz:

The U.S. State Department explains in Section 349 of the INA (8 U.S.C. 1481), as amended) that U.S. nationals are subject to loss of nationality if they perform certain specified acts voluntarily and with the intention to relinquish U.S. nationality. Briefly stated, these acts include:

* obtaining naturalization in a foreign state upon one’s own application after the age of 18 (Sec. 349 (a) (1) INA)

OR

* taking an oath, affirmation or other formal declaration of allegiance to a foreign state or its political subdivisions after the age of 18 (Sec. 349 (a) (2) INA).


According to Ted Cruz’s father, he and his wife applied for and received Canadian citizenship before his birth in Alberta. Thus his mother committed the act of obtaining naturalization of a foreign state, which meets the definition of a an "expatriating act."

AND (this is important), until 1977, Canada required those seeking Canadian citizenship to swear an oath renouncing their allegiance to their previous country. If Ted Cruz’s mother obtained Canadian citizenship before 1977, then she swore this oath before a Canadian government official.

Based on these facts alone, Ted Cruz is not eligible to seek election to either the offices of President or Vice President. He must either withdraw from the current primary race, or the GOP must disavow his candidacy and expel him from the remaining primary contests upon this basis.

yup
bet he is not legally qualified to be Senator in Texas.
a cancelled canadian citizenship 14 mos ago does not mean he is legal here... unless there is legal paperwork making him legal. A rescinded citizenship in one country does not imply or commute citizenship in another. He may just be a man without a country. Period.

If so, we may have an illegal alien sitting senator, fooling the good folks in Texas.

John Jay, who became our first Supreme Court chief justice, sent George Washington a letter confirming that the only way to ensure the U.S. presidency remains free of what today we’d call “foreign entanglements” was to limit eligibility to natural-born citizens.

Washington replied, thanking him for the advice. In editing the final version of the Constitution, the framers changed Article II from "citizen" to "natural born Citizen."

Records of all this exist.

From the record: “Permit me to hint, whether it would not be wise & seasonable to provide a strong check to the admission of Foreigners into the administration of our national Government; and to declare expressly that the Command in chief of the American army shall not be given to, nor devolve on, any but a natural born Citizen,” John Jay wrote to George Washington on July 25, 1787.
