It’s merely a preliminary injunction here. The lower court has not yet ruled on the merits of the case.

My opinion is SCOTUS should rule the PI should stay in place until the lower court has tried the full case. SCOTUS should not have even agreed to review the PI.

PIs are taken up on appeal all of the time. If you can't show a likelihood of success on the merits--one of the bases for obtaining a PI--then it's an almost sure bet you won't succeed on the merits.

My guess is that Kennedy, Thomas, and Alito are going to vote to uphold the ruling, while the four libs are going to vote to reverse it, with Roberts voting to throw the whole thing out on the issue of standing (thus siding with the libs in effect).
