Reining in a rogue bureau: CFB tells Congress on spending $216mm “Why does that matter to you?”

A federal appellate court questioned Tuesday whether the structure of the Consumer Finance Protection Bureau (CFPB) violates the constitutional separation of powers. That question has been on the minds of constitutional scholars and administrative lawyers ever since the Dodd-Frank Act brought forth this Frankenstein agency, which wields all the power and jurisdiction once exercised by seven separate agencies over great swaths of the economy, all without any meaningful oversight by the political branches.

What federal agency would have the gall to answer Congress’ legitimate questions about its extravagant spending with the retort, “Why does that matter to you?” That was CFPB Director Richard Cordray’s response at a congressional hearing to a question about the bureau’s $216 million renovation of its rented building in Washington, D.C. (At a rate of almost $600 per square foot, that is more expensive than the cost of constructing the famously luxurious Bellagio Hotel in Las Vegas.) But Mr. Cordray’s impudence is to be expected from an all-powerful federal agency with a virtually limitless budget, free of any risk of congressional defunding.

This agency isn’t subject to appropriations, it doesn’t have a 5 member board as all the others do. It has O then Cordroy. It took rules masterfully run by the FRB and put it in the hands of one guy. Their MO is to pick targets and fine them absurdly, and say sue us. The litigation is so expensive no one will fall on their sword and take this thing down, instead paying the fines. This is as un-american as it gets. Its the rule of man over the rule of law.

An agency like this has enormous potential for an administration to help its friends and punish its enemies. With the “right” political donations, the threat of fines can be reduced or set aside in consideration of political cooperation. The potential for corruption is wide open and believe me, the Democrats are good at that that.

Someone needs to bring this rogue agency under some proper supervision and oversight. Unfortunately, it won’t be done under Paul Rino.

The Democrats have been ruling by the man rather than the law for 7 1/2 years (at least). Time and again, the half breed has shown his contempt for Congress, the courts and the law. HE IS THE LAW.

Now, a day late and a dollar short, comes the GOP Establishment and its paid lackeys attempting to do the same. Unfortunately for them, the people who have been screaming for them to do their job, are not going to allow it.

I thought it was an atrocious idea when I first heard it announced at the AF JAG Keystone Conference that year - don’t remember who, but some mucky-muck’s wife was announced as liaising between DoD and the thing.

Yes, the Founding States gave the “power of the purse” uniquely to the House of Representatives as evidenced by the Constitution’s Clause 1 of Section 7 of Article I. I’m glad to the see the first post of this thread pointing the finger at the main problem, Speaker Ryan, with respect to the CFPB’s spending.

Another problem is that we have a corrupt Congress that is stubbornly refusing to fire people like the CFPB director.

Remember in November !

every govt group is subject to an overseer, being congress which approves 100% of the govt costs each year.
