I don’t see how it can go anywhere legally. The key for battery is intent to harm. I don’t see that.

Actually, the key to simple battery is touching someone against their will. This clearly meets that definition, and he will be found guilty of this misdemeanor charge.

You are incorrect. Under Florida law (and the common law as codified in most states), simple battery requires an intentional touching without consent. An intent to cause harm is not an element of simple battery. With that said, I can't imagine any prosecutor pursing this case based upon what I saw (and didn't see) in the video. Even if CL intentionally touched her, I would argue that she gave her implied consent by venturing into the personal space of a presidential candidate at a crowded campaign event.

If I’m on a jury this takes about one minute to get the votes tallied from the other jurors for a not guilty verdict. The prosecutor has to be a pure idiot to take this into a court room.

This woman is obviously in search of her fifteen seconds of fame at the expense of someone else. Were she a man would this even be an issue? I heard a local talk radio personality ask this question and preface it with an up front apology and it took all of one minute for the sexist card to get thrown on him and he back peddled like a big wuss bag from it to kowtow to the new fascism known as PC.
