If he doesn’t sue, it will be because he knows he can’t win against the NE. The NE has years of practice in smashing down slander lawsuits. They know how to write articles just so to make such lawsuits against them beatable. If they didn’t they would have gone broke years ago considering how much of what they publish is BS or questionable.
