Burns, OR - An FBI agent is suspected of lying about firing twice at Robert "LaVoy" Finicum and may have gotten help from four other FBI agents in covering up afterward, authorities revealed Tuesday.
The bullets didn't hit Finicum and didn't contribute to his death, but now all five unnamed agents, part of an elite national unit, are under criminal investigation by the U.S. Justice Department. Inspector General Michael Horowitz is leading the independent inquiry.
The remarkable disclosure came as a team of local investigators released findings that two state troopers shot Finicum three times in the back during the chaotic scene at a police roadblock Jan. 26. One bullet pierced his heart, an autopsy showed.
A prosecutor ruled the fatal shooting was legally justified, saying state law allows use of deadly force when officers believe a person is about to seriously injure or kill someone. Finicum kept moving his hands toward a pocket that contained a loaded handgun. Although he was shot from behind, Finicum had a trooper in front of him armed with a Taser who was thought to be in danger.
Finicum, 54, an Arizona rancher, was one of the leaders of the Jan. 2 takeover of the Malheur National Wildlife Refuge near Burns.
Investigators gave no details to explain why the one FBI agent, a member of the Hostage Rescue Team, wouldn't report the two shots. They also didn't indicate what his four colleagues on the team did to warrant investigation other than saying it was related to conduct after the shooting.

They didn't approach the vehicle, they were just waiting for him to get out, so they could shoot him. Instead he drove off.
So...one has to consider what is the difference between 'suicide by cop' and 'refusing to die on your knees' (to an oppressive government that wants your land and is willing to kill you to get it) ?
Did he leave the truck after they started firing?
It appears so and this suggests an effort to keep the others from getting shot.
I was going to comment on how tough that truck was as well.
This may well be as you said but when you put yourself on the front lines and taunt someone to shoot you occasionally someone may take you up on it. This man seemed to accept his fate.
They left the refuge because like idiots they believed the FBI wouldn’t murder them. They were going to a rally and to talk to a county sheriff. They had NO GUNS in the truck as far as anyone knows. The FBI is claiming Lavoy had a 9mm but no where in any of the videos do you see a 9mm pre or post shooting. If Lavoy indeed had a 9mm it would be clearly seen removed from his pocket when they had people go up to the body. So right now the only evidence of a weapon comes after all the cameras turned off. Whats more is they the officers who shot him were looking at his back... from the videos is looks damn near impossible they could have seen a weapon. They only thing they could have seen is him reaching into his jacket. No grounds for shooting.
As to the stay and fortify... you got to remember that these people never really wanted to fight with the FBI. They were hoping to have the same event take place where the FBI was forced to heel by to many cameras. This also goes back to the top... the idea was to get media attention they went to rallies and such to do this.
Why did Lavoy jump out of the truck?
Most likely he knew that the FBI and crew intended to kill someone to send a message. By leaving the truck he gave them a chance to go after him instead of shooting up the truck. He probably saved the lives of everyone in the truck.

Yes and No. The belief by many was that now that they pushed back the BLM/FBI/etc that the FBI/etc wouldn’t be brave enough to arrest them. This was correct. The FBI while having a ton of data on these people tucked tail and ran. The FBI believed if they started arresting people their would be a militia response.
Fast forward to today. FBI shooting militia man in ambush... now clearly seen in the tapes from inside the truck as murder. No militia response at all except some hand waiving... no dead FBI/BLM/etc. No armed resistance of any kind. FBI and company are emboldened and are now locking up the bundy ranch supporters... because they now know the militia is a paper tiger.

What’s this about the shooters being charged with murder or some such?
I have a copy that I found somewhere as a PDF. I converted it to an epub and have distributed it to several interested folks. The cameras you see at every intersection have nothing to do with traffic control. They are there to prevent Unintended Consequences from happening.
There was no line of tanks driving directly at the conflagration. Somewhere there’s an analysis dissecting the photo and showing what it was composited from. Suffice to say it’s fake.
If he had gotten out of the truck at the first stop and surrendered he would have been taken into custody like those who did.
Instead, he told the LEOs more than 10 times to kill him, said others were coming to assist them and threatened that there would be a "bloodbath", and fled the scene.
All after publicly stating that he'd die before going to prison.
There's plenty of blame here to go around but LaVoy brought this end on himself.
They made a point of pulling them over where there was no cell service.

Wow. I’ve never heard that aspect of his story. If true, then I’m just stunned at how much worse his experience was than I was aware. I would have lost my damn mind in short order. Same goes for Ruby Ridge. I can’t imagine.

None of that gives the cops the right to kill nor is any of that against the law.
I just don’t get how people don’t understand simple commands looking down the barrel of a gun of a law enforcement official. Don’t move, put your hand up and drop to your knees or some variation of the above. If you move an inch as if you are reaching in your pocket your dropped. It is truly that simple.
If you reach where it is later found a handgun existed well 1) your intent was of bad will and 2) you didn’t deserve to exist any longer
We need less stupid people, abide by commands, hire an attorney and let the courts figure out if you were right or wrong. The other choice, well we see the results
