First, according to your theories trump, and Cruz are either both legal, or both illegal. You can’t argue that facts work one way, and in another way it works differently.
Second, the reference to the Law of Nations, was in regards to dealing with the recognized rules in which nations interacted. Vattel was certainly a noted and respected scholar, however he was still swiss. Our founders where English, we were English, we upheld English law, and when the constitution was ratified it was based off of English common law.

You are so wrong it is pathetic. Obviously you have never learned to read with comprehension. How can Cruz and Trump be equal when Cruz has one point out of three...his mother was American. Trump’s parents were BOTH American. Cruz was born in Canada. Trump was born in New York which the last I looked was in the united States. Cruz 1/3, Trump 3/3

While there were some things based on Common Law, in general the Constitution was NOT the SOURCE of American Law. It is recorded that one of the Constitutional Committee said so. British Common Law dealt with SUBJECTS of the KING. The King granted them whatever “rights” he pleased. In America it is the PEOPLE...remember from the Declaration of Independence...WE THE PEOPLE....who rule. We have no king and are NOT subjects, we are freemen. As of July 4, 1776, Americans were NO LONGER SUBJECTS OF A KING, THEY WERE CITIZENS OF A FREE AND SOVEREIGN NATION!Subjects and Free Citizens are entirely different.
Vattel was THE INTERNATIONALLY ACCLAIMED EXPERT on INTERNATIONAL LAW! Dismissing him as just Swiss is rather narrow minded on your part. He was taught in all our universities and a fairly recent dissertation on Vattel was given at the University of Virginia. It is worth reading. We had just finished fighting England for our independence. Why on earth would we set up our Constitution based on the very thing we despised and fought a war to destroy?
