What is on the killer’s phone that is not available from provider’s phone records (numbers, time duration), GPS tracking records (location over time), emails (archiving) from internet providers???? NSA is supposed track terrorists!?!
All that can be acquired without having the physical phone.

It all looks like another version of going after the gun ban after random killing.

What is left of citizen’s privacy ???
You already pay for your phone that gives the almighty government free access to your private activity.
Yeah, freedom for terrorists, spying on citizens!

Just... Wow! Well, I have respected Judge Napolitano’s commentary before, But, I just have to say that he has really gone over the top in this case.

First off, he has bought hook, line, and sinker, Apple’s premise that the whole world as we know it will come to an end if Apple does something that many other companies have already done thousands of times in the past: cooperate with lawfully issued warrants to help with criminal and/or terrorist investigations.

I do NOT accept Apple’s premise. I think that it is absurd for them to argue that by merely helping the FBI retrieve data from this one phone, for this one terrorist investigation, as lawfully approved by a federal judge, would put all Apple device users at risk. Apple has now engaged in ridiculous fear mongering rhetoric that if they cooperate with this FBI request, that their code for helping break the password protection on this one phone could not be stopped by their own cyber security from being stolen. Well, in that case, that is NOT the FBI’s problem, but Apple’s alone.

I would also remind the judge that, as has been pointed out many times before, the US Constitution is NOT a suicide pact! US citizens do NOT have to compromise their safety for the sake of freedom.

There is NO right to absolute privacy codified in the Constitution. In fact, the Founding Fathers knew that it could never be the case, and it finally was wisely proscribed by a limited compromise; the Fourth Amendment; whereby the government has the authority to effectively invade your privacy, but only if there is reasonable probable cause to do so.

In any case, even if Apple wins this little battle, they ultimately may lose the big war in a very spectacular fashion. Their refusal to assist the FBI in a legitimate terrorist investigation will most likely piss off just about everyone involved in a sworn duty to protect and defend this country from harm. It will most certainly prompt the likes of the FBI, NSA, and CIA, and any other responsible group to just go all out and do EVERYTHING in their power to crush the likes of a left wing uncooperative terrorist protecting company CEO’s like Apple’s Tim Cook... and thereby eventually resulting in Mr. Cook’s worst case fear mongering scenario... the government WILL be able to break any “privacy” that citizens hold dear, and for which they have been falsely insured exists.
