I was unclear. I was referring to the discussion.

In a perfect world we could wait to have this discussion. Secure in the knowledge that our President would fulfill his Constitutional duty.

However we are in the real world. Our President is committed to expanding government and twisting the Constitution into a pretzel. So we have to have this conversation now, before Justice Scalia is even laid to rest.

It is sad, but a symptom of our times.

We are forced to have this discussion because SCOTUS is politicized. It used to be the firewall for the Rule of Law. No longer. It has become involved in legislating social changes like abortion and gay marriage. SCOTUS approved Obama's implementing Obamacare in violation of the law itself.

Nine unelected people in black robes have exceeded their authority under the Constitution. Only Congress can rein them in.
