Correct. But Kennedy has been much worse, and he was a Reagan appointment. Go figure.
I’m sure Kennedy enjoys the power of being the swing vote.
Kennedy was a third choice. First came Bork, who should have been confirmed. Then came, ironically, Douglas Ginsburg, who had some problems relating to his activities as a law professor. Kennedy was the result of confirmation fatigue.
