Given the packing of the DC Circuit by the Dems just before they lost control of the Senate, Scalia’s death is especially troubling. The most important Circuit Court of Appeals will rule in ways friendly to liberals, and the Supreme Court will not have the votes to reverse. On the other hand, that packing by the Dems can be used to justify delaying any confirmation until a new President has a chance to pick his successor.
We should break up some of the circuits into at least two and maybe more, thus creating a bundle of Circuit Court vacancies for President Cruz or President Trump or whomever to fill.
