Trump threatens to sue Cruz for 'not being a natural born citizen'

Donald Trump on Friday threatened to sue Ted Cruz for "not being a natural born citizen" if the Texas senator "doesn't clean up his act" and stop running negative ads against him.

"If @TedCruz doesn't clean up his act, stop cheating, & doing negative ads, I have standing to sue him for not being a natural born citizen," he tweeted.

Trump has previously argued that if Cruz won the Republican nomination, Democrats would argue that the Canada-born Texas senator was ineligible for the presidency. Last month, Trump asked a rally if he should sue Cruz "just for fun" over the issue.

Trump has standing because he is running against Cruz on the same ballot.

But that's not a ballot for President of the United States, it's a ballot for the Republican nomination. Any legal challenges about citizenship are technically premature for the nomination.

In other words, if Cruz gets the nomination, those with standing to sue are the Democrat nominee and nominees/candidates from minor parties.

If Trump doesn’t do it and if the recent Candian doesn’t admit it and drop out, we’re going to have Hillary. If Obama gets his way, as he always does, “they” will somehow get Cruz on the ballot. At the last minute, Hillary will pull the standing card and sue. That will put the election on hold for the two extra years Obama said he’d have (remember he said he’d be POTUS 8-10 years). After a couple years, SCOTUS will kick ineligible Cruz to the curb and crown Her Royal Hineyness. The unemployed Kenyan will have his shot at the UN. Then toward the end of Hill’ first term, she’ll pay her debts by appointing the muslim to the Supremes.

I don't see where Trump has any standing to do this.

That is the problem with this whole issue - who has standing? Cruz can't do it - who would he sue? A voter can't do it - no standing. Perhaps the only one who can do it is another candidate. But then you get to the question of whether the court will hear the matter even if the plaintiff has standing if they do not consider the issue "ripe". They may decide that no injury has occurred unless and until Cruz wins the nomination - if he doesn't win, the issue is moot. The court does not pre-emptively rule on POTENTIAL injuries, unless the likelihood that the injury cannot be remedied afterward is extremely high.

Opponents on the same ballot have standing. Qualified perhaps by finding that some opponents don't have a snowball's chance of winning the election contest. Some courts might wait until after the election, and allow only the second place finisher to sue, others might take the case just to preserve the integrity of the ballot.

Ironically, a court might find Trump to lack standing because he'd likely win, regardless of who else is on the ballot.

If Cruz won the nomination ( which will never happen ) you can be damn sure the Democrats will challenge his ‘Natural Born Citizenship’.

Kind of interesting that the founding fathers spelled out an important qualification to the presidency but yet there doesn’t seem to be a quick way to resolve any questions pertaining to a candidates eligibility.

I think you meant "Any legal challenges about citizenship are technically premature for the general election". If the question is the nomination, the challenge is not premature during the nomination process. It is a moot challenge if the unqualified candidate gathers little or no support, and it is a moot challenge when brought by the winner.

The way I see it, the best argument in both primary and general election contests looks at ballot integrity, as a function of the government (state election offices) not facilitating fraud on the public.

Cruz supporters say Trump ought to sue to get the issue settled, then when Trump threatens to sue, they acuse him of grandstanding. I suppose those aren’t necessarily incongruous positions, but the combination does ring of goading somebody into doing something so you can ridicule him for it.

It’s also Trump getting headlines and bringing attention to Cruz’s slimy campaign. All art of the deal tactics: make a claim to get attention but the real attention is to Cruz’s ads and so forth. Smart Trump.

If the question is the nomination, the challenge is not premature during the nomination process.

I would argue it's moot for the party nomination as there is zero requirement that someone be a natural born citizen to become a party's nominee. Only to become president.

If they wanted, I think a party could nominate just about anyone regardless of age, citizenship, etc. But it does not mean they would qualify to be president.
