This would be in the state court, not federal. That said, what federal case law do you think has bearing on the matter?
The Federal Claims Tort Act has it's little sister versions among the states and municipalities.
My daughter is an environmental lawyer. There is no money in going after any level of government for such matters. Now private entities......that's another matter.
