Oh, and did it ever enter your thoughts that maybe an equal protection lawsuit related to drafting only men would result in a court order to draft equally from both sexes?

Well, I suppose it did technically "enter my thoughts, but it would never happen.

What would happen if Rostker is overturned, which I think is likely, is that the Court would invalidated a male-only draft registration or actual draft. It would not, however, order the registering or drafting of women.

I agree that Rostker would be unlikely to be sustained given the decisions to allow women to participate in front line combat. And yes, the Court would not order a draft for women, but as you noted would invalidate the male-only draft.

So practically speaking, the idea of instituting a traditional style draft based on existing Selective Service registrations seems to me to be a waste of time and money.

I think a much better approach would be to scrap the Selective Service system, and instead focus on enhancing organizations and databases related to securing rapid assistance from already trained individuals.

For many of the kinds of emergencies we might face in the future, just having the names and mailing addresses of a bunch of young people won't be particularly helpful.
