Because no judge can do such a thing, only congress has the power to make that assessment.

If Cruz produces a Consular Record of Birth Abroad, it will PROVE that he is naturalized & not natural born. So if he just stonewalls it, he can insist that he’s NBA & ‘’there’s nothing anyone can do’’.

God, this guy is such an anti American snake. He makes me sick.

And just like your typical progressive, Trump wants the courts to get involved and overrule the will of the people, and reimagine the law in his favor.

Trump is no idiot, but he acts like one, especially on this birther issue. He knows Cruz is eligible, and his continued efforts to push this issue is going to hurt him more than it will hurt Ted Cruz.

Unfortunately, this is not something that is going to go away. The most recent poll that had a thread here on Free Republic showed that just 51% of Republicans were sure that Ted Cruz was eligible and 49% either thought he wasn’t or were not sure. I would hate to sample Democrats in the general election but it will be used. At this point it is less a legal question than a political question.

That said I wish that the Trump campaign would leave it alone right now. They don’t need to do it and it just leaves a bad taste in many peoples’ mouth. But Trump is a brilliant strategist obviously who is several moves ahead of most of us... so either Ted just pissed him off and he doesn’t care or he just feels like this is something important.

That ain’t the way it works. Being the Constitutional scholar he is, let Trump decide to sue Cruz if he believes Cruz is not eligible. Otherwise, it is assumed he IS until proven that he isn’t in a court of law.

I’m sure having access to the best lawyers money can buy, Trump will have no difficulty pursuing this avenue. Unless of course, most Constitutional lawyers think Cruz is right and how the Constitution does not support Trump’s accusations.

He might want to sue Rubio also if Rubio threatens his lead in the polls. Oh well, he who has the gold...yada yada

Trump won’t face Cruz one-on-one because he knows his castle of cards would fall to the ground.

Trump is an empty $2,000 suit.

What Trump said was after a judge rules he’s an American citizen eligible to run for president, he’ll debate him, if the last two candidates standing are Cruz and him. That’s never going to happen. Cruz is scared to get a judge involved and after last night’s debate Cruz is finished. He’s currently running 5th in NH. Even if pulls out Iowa, he’s not winning NH and he’s not winning SC, where Trump leads him by double digits.
