The Constitution gave Congress the authority to create laws for Naturalization. If a law enacted by Congress gave you citizenship were as without it you wouldn’t have citizenship, you were naturalized. The laws enacted by Congress define the process of naturalization and are not solely limited to the process set forth for immigrants.
Ted Cruz was born outside of the United States to a mother who was a US Citizen. Ted was eligible for citizenship at birth because his mother was a US Citizen and she met the statutes within the Naturalizaton Laws passed by Congress at the time. Ted was able to retain his citizenship because he moved to the US and has been residing within the US since. Hypothetically, If Ted failed to move to the US before a specific age he would have failed to adhere to the requirements with the Naturalization law to maintain his citizenship. Thus he would have to be naturalized as a foreigner.
In the end, Ted only received citizenship through law/statues enacted by Congress and there for is a naturalized citizen albeit at birth.
See Post #61. In my opinion this is where the problem lies.
Wow! That just happened to me this AM
Since it’s a constitutional question, it can’t be settled by any administration. Congress could settle it if they had the balls to pass a law and forbid the court to overrule it, subject to their authority do impose whatever “regulations and exceptions” on the courts’ jurisdition they choose. They have never done so. Otherwise only the courts can settle it.
“The law at the time of his birth applies, not 1916 or 1952.”
Yes, and that is exactly why you were asked the question, you willfully ignorant fool. Wake up knucklehead and stop denying that 1952 NATURALIZATION law. Natural born citizens cannot be naturalized, because they are already natural. Ted Cruz is a naturalized U.S. citizen. If he were a natural born citizen as claimed, nothing would have prevented him from being a natural born citizen of the United States in 1970, 1870, or 1820. Because Ted Cruz is a naturalized citizen, he would have been born a British citizen and could not have been any kind of U.S. citizen before 1934.
” You Trump cultists selectively pick and choose old or non-applying statutes and then try to pass it off as current.”
There you go with another of your stupid and ignorant lies. I am not a Trump supporter. In the past I have served as a delegate to the Republican convention, and it is likely that I will be asked to do so again this election. My endorsement will not be committed until the caucus.
“Go ahead and believe the courts are going to rule on this.”
There you go again with your ignorant running off at the mouth again. Some of us took an oath to protect and defend the Constitution against all enemies, foreign and domestic, which includes people who trash the Constitution by willfully abrogating it for partisan political gain.
“They have run from this for years. Trump, Cruz and Rubio are all natural born citizens and their chances of being president depend on the voters not judges.”
The previously quoted Naturalization laws used by those people to acquire their U.S. citizenship prove they are no more of a natural born citizen than other naturalized citizens like Arnold Schwarznegger and you are a bald faced liar asserting what you cannot possibly prove with evidence that does not exist.
I recently noticed that as well. I stopped going to Breitbart because idiotic and insulting comments from the Trump supporters. All they do is attack even if you have a valid argument. I havent been on FR for very long at all and so far everyone on both sides here give intelligent thoughts, etc.
Bless you little heart. You do know that every person running for every office in the land is lying about something don’t you? Yes even Cruz.
Yes, very sad all around.
Nope, he gave it up the first time he voted in the USA. By the way, since you claim to know all, when was he first issued a passport?
Are you referring to his Cuban passport?
“Nope, he gave it up the first time he voted in the USA. By the way, since you claim to know all, when was he first issued a passport?”
The news articles reported Ted Cruz did not renounce his Canadian citizenship until 2014. They also interviewed Canadian constitutional experts and Canadian experts on their citizenship that Ted Cruz was still a Canadian citizen whether or not he wanted to believe and/or say differently.
Nothing solidifies the stated gratitude like a donation to help keep the lights on....
Now for a short public service announcement to all on FR:
We need to ensure we don't get another Obama-like America Hater as the next President.
The best way to ensure that is to actively support a candidate (even if he's "rich enough to do it on his own") as the next President.
I donate to the candidate I support and you should too, else, your "support" really doesn't have any meaning.
It's even worse if you use FR and don't donate. If you are one of those who feel it's OK to use FR daily w/o helping pay to keep the lights on, then please don't complain about the welfare leeches because, functionally, you are no different than any other who enjoys the fruits of others' work for your own benefit. Also, don't be surprised if others decide that your opinions are as worthless as your non-donations - hypocrites aren't worth listening to.
PS - If you are one of those unlucky few who cannot afford even a small donation to FR or a candidate, God Bless and happy FReeping!.....
Very well stated.
Just as Fox news has veered left, it looks like Britbart may be doing the same. AB would be horrified.
If he were right, and Trump wasnât, then his children couldnât be NBC his grandchildren arenât, ad infinitum. It's worth noting that 4 of Trump's 5 (acknowledged) children were born to non-citizens, so according to the "birthers" those 4 children of the presumptive next President are not eligible to to be President.
I don't buy into the "birther" nonsense, but I would love someone to ask Trump which of his children he believes are eligible to be President.
Fascinating, educational discussion. Thanks to every poster. BUMP-TO-THE-TOP!
Of course, in today’s US, facts are irrelevant. What matters is how one self identifies. Rafael identifies himself as a NBC, just like Caitlin Jenner identifies himself a woman. And the courts seem just fine with one, or both examples.
The whole NBC subject is about avoiding split allegiance. The son of a communist freedom fighter (Cruz is unquestionably eligible for Communist Cuban citizenship) was indoctrinated since birth to the communist doctrine. To believe otherwise is to also believe 0bama was not influenced by his muslim upbringing.
