New citizenship suit challenges Ted Cruz's eligibility to run for president (Cruz sued in Texas)

A Houston attorney is filing a lawsuit in a U.S. District Court challenging Texas Sen. Ted Cruz's "natural-born" citizenship and his eligibility to run for president, fulfilling a recent prediction by GOP front-runner Donald Trump.

"This 229-year question has never been pled, presented to or finally decided by or resolved by the U.S. Supreme Court," 85-year-old Newton B. Schwartz Sr. said in his complaint, according to Bloomberg News.

Schwartz called on the nation's highest court to take up the issue quickly, saying that "time is of the essence" as the country's first nominating races in Iowa and New Hampshire draw near.

Schwartz added that he filed the paperwork himself and was "amazed no one did it" before.

The Houston attorney said he had "nothing against" Cruz, but told Bloomberg that he "probably" supports Democratic contender Bernie Sanders.

Cruz should echo him. This needs to be resolved asap. This is hurting Cruz and having the SC rule in his favor would nuke this attack line.

I think the Obama cases have clearly shown that citizens have no standing to bring such suits and I expect it to be thrown out like every other Obama one.

Unless, of course, the courts simply were acting in Obama’s best interest and this case, since it is against a Republican, has standing...

Cruz's opportunity to get ahead of this is waning. If only he had people among his campaign managers reading Free Republic, he'd have handled this so much better and probably already managed it. But alas, he is blowing it. And his opportunity to redirect is nearly behind him. That leaves us with Trump, FRiends. For better or worse.

Is he going to have "standing"? How is he "injured"?

This I gotta hear, because apparently Obama as President couldn't "injure" anyone, and so no one has "standing."

I've said for the last several years that the law works different when conservative causes are being advanced. Liberals can get away with crap that they won't allow for us.

We'll see if he has standing. I'm betting the judge is going to figure out a way to say that he does.

On the contrary. If a Houston attorney is filing this in Texas, it would stand to reason that the court is probably on the Conservative side and will toss this. That will end it.

I agree. Cruz apparently does not read FR, because he has not provided the courts any cover to duck the issue until the People have spoken at nomination time. (By design the courts are not supposed to provide council as to future evidents --- with reference to a Washington / John Jay discourse regarding treaties.) Instead he has employed Obama's "nothing to see here" strategy. Which only works for liberals and peeves conservatives, putting both camps in part against him. He is choosing poorly.

In order to end the controversy ( suit has already been filed in Florida against Rubio). The RNC needs to file for a Declaritory Judgment with the SCOTUS naming Cruz, Rubio, Jindall and even Trump.
This would settle the issue once and for all

In fact the idea that last night was just kabuki to set the script for the next scene has crossed my mind. If you listened carefully Cruz said that DonAld had said he thought Cruz was when they met with Donald’s lawyers. He DID NOT Say what the lawyers said ..... Hmmmm
