You need to read the 1790 act
I don’t think anyone has ever had it clarified to run
It is the only founders use of the term natural born
And it specifically claims father has to be a citizen if child born abroad
To be a regular citizen it only takes one parent to be a citizen if born abroad
The Dems will bring suit for clarification better to get a ruling now
Romney had two US citizen parents
McCain as well both parents US citizens and he may have been born on US Canal Zone land I’m not sure
Goldwater too I think and born on US territory
Cruz had a dad with Cuban and Canadian citizenship at least and a US mom and was born on foreign soil and I think was a Canadian citizen as a boy till he moved here even though he qualified at birth as US citizen
But is he a natural born citizen per the founders design?
I’m not sure
I support Cruz or Trump but I’d rather know now than later and I think it’s a legitimate question
So far all I see if huff and puff over it even from sources I usually agree with
No one seems capable to be impartial and really figure it out
It’s just sound and fury
At birth, he was qualified to receive a Consular Report of Birth Abroad, as authorized by statute under Congress' authority to make an uniform rule of naturalization.
Whether he did or did not receive a CRBA in a timely way or not is unknown. His campaign posted his Canadian birth certificate, so far, I don't believe we've seen his CRBA.
It is most certainly NOT a resolved issue (and it may be unresolvable) whether the son of an alien father born abroad is an NBC. If there is a way to resolve it, the GOP should move promptly to do so.
But there may be no such path to resolution. The courts decide "cases and controversies", they don't generally respond to requests for clarification and they don't issue declaratory judgements without a plaintiff or injured party. It's not clear that there is such a person here.
Son of an alien father, born abroad.
Citizen by statute? Probably (his mother may have had dual citizenship, we don’t know).
Natural born? Completely unclear. If a computer designed a test case, this would be it. But we do not clearly have a plaintiff with standing.
