How Donald Trump made the birther attack on Ted Cruz stick

Eight days ago, Donald Trump floated the idea that Ted Cruz might cause Republicans some legal headaches if he won the GOP presidential nomination because he was born in Canada -- albeit to a mother who was and is a U.S. citizen.

Today, Cruz's citizenship -- and the questions surrounding it -- is the single most dominant issue in the Republican race and has, without question, slowed Cruz's momentum in Iowa and nationally.

It's a perfect case study in both how Trump attacks and how he's able to so effectively sidetrack his opponents.

-- The rule is pretty clear- anyone born to a natural born citizen- regardless of where they are born, can run for president provided they meet the other two requirements- ie lived here 14 years- and the other one I can't remember right now- --

Let me help you: Both parents have to be U.S. citizens and you have to be born in the U.S.

Think of it in terms of a hypothetical election ... "When asked to show he was a US citizen, the candidate produced a birth certificate from Iberia, people were concerned that maybe he wasn't a citizen of the US at all, but instead was a citizen of Iberia."

For the voters who believe Cruz was born in the US, that issue is totally missing.

Some low information voters think that where a person is born, matters for citizenship purposes.

Citizen is not the issue. There is a special class of citizenship. The term for it is natural born citizen. Framer John Jay knew what natural born citizen is when he told George Washington to put it in the Constitution. He got it from Emer de Vattel’s highly acclaimed and influential, “The Law of Nations, Or, Principles of the Law of Nature, Applied to the Conduct and Affairs of Nations and Sovereigns,” Section 212 (1758 French) (1759 English).

Where did you get that idea from Emer de Vattel's words? Vattel said that a natural born citizen was one where the child was born in the "settlement" (U.S.) of citizen parents.

Thee is citizenship and there is that special class, natural born citizen. Both are citizens but one must meet a higher standard.

First of all, this started when The Donald was asked the question on a talk show. When you are asked questions like this, you start thinking. Trump had already looked into Obama’s eligibility and this was well-tread territory. When Cruz’s eligibility was brought to light, how could Trump ignore it? When I looked into it, the red light went on. The red light should have gone on for you too, unless you are blind.

Securing the border and removing the foreign threats within the United States is the first, second, third, and fourth most important issue of this election cycle.

That is why Trump is even considered.

If that sentence says, if I can decipher it, that "Ted" Cruz is a natural born citizen, you are wrong. He may be a U.S. citizen but he is not a NBC--a natural born citizen. The term natural born citizen was well known by the Founders and Framers of the Constitution. We just don't know what it means because we don't know the history of the founding.

Because Rafael Edward “Ted” Cruz was born to an U.S. citizen mother, he is an U.S. citizen. However, his father, Rafael Bienvenido Cruz, was a Cuban citizen at the time of “Ted’s” birth. “Ted” Cruz, having a law degree, should have studied the Constitution and known the eligibility situation he was in. The basic thing is, he does not meet the special requirements to be a natural born citizen: A child must be born in the U.S. to parents who are both U.S. citizens. This is not rocket science folks.

Thank you for the superlative job of getting together the valuable background information that illuminates Rafael Edward "Ted" Cruz's eligibility status. If people read this material, they will answer for themselves that Rafael Edward "Ted" Cruz does not meet the requirements for eligibility.

You just hit upon a very important point. No one cared about where Zero was born except a few “birthers.” And that question was first unleashed by the Hillary Clinton campaign against Zer0 in 2008.

The important thing is Zer0’s pass on the question of eligibility set a precedent. If Cruz can prove that Zer0 failed the eligibility requirements, then he should be able to run for President too. This legal fight might require that Hawaii give over Zer0’s birth certificate they have on file to prove that he was born in Hawaii. The precedent evidence will have to be thorough to establish that Zer0 set enough precedent to allow Cruz to go through.

Not only was Mark Levin not his best on the Cruz NBC issue, so was Rush Limbaugh. I couldn’t believe Rush would make the same mistake. There is a fuzzy logic going on that would confuse citizenship with natural born citizen.

Since I’m not able to channel Trump like SOME PEOPLE HERE, I’ll trust his words that he’s telling me the truth in this campaign, and Rush’s words about Trump, which are the same.

Well excuse me but if our concerns about Obama’s eligibility just came to naught, then too bad, any person’s concerns about Cruz’s should too. We already gave up that ground when we yielded to Obama and Jarrett on this.

And.....all those objections .. came to NOTHING... That ground has already been given up to the other side!!! If it hasn’t, then the military needs to go in and seize Obama and eject him from the White House now. Oh wait, that won’t happen, will it?

I completely agree. If those of us with objections can’t make them stick against Zero, we can’t make them stick against anyone. And Cruz is a minority, too — Cuban — which we were told should make our objections against Zero moot (he’s disadvantaged, why should we CARE where he was born)... Don’t get me wrong, I am a lawyer, and I agree with George Washington’s concerns about “foreign influence” but the camel already has its nose in the tent....
