On January 6, Arizona's governor Doug Ducey announced that he was appointing Clint Bolick to a vacancy on the state's supreme court. I think this is a splendid development, but it also has statists in a tizzy. Bolick, you see, is not your typical Republican judicial appointment.
Bolick graduated from law school (UC-Davis) in 1982 and soon took a job with Mountain States Legal Foundation. But he did not stay long because he found it to be more interested in protecting business interests than advancing economic liberty for all. In 1991, he co-founded the Institute for Justice with William Mellor and IJ has ever since been a completely principled advocate for any and all Americans who simply wish to be free of onerous, unjustifiable government rules and regulations.
(I have written here about a number of IJ cases, such as this appalling travesty of justice in North Carolina.)
What I find so wonderful about Bolick's appointment is that it puts on the bench a legal practitioner who has for many years fought in the trenches against the omnipotent state and understands far better than most judges that courts must stop rubber stamping government actions that should get strict scrutiny. Many Republican judicial nominees have turned out to be lukewarm at best when it comes to challenging the vast regulatory state and upholding individual property rights and freedom to peacefully engage in business. Bolick is not cut from the same cloth as, oh, Chief Justice Roberts.
For the statist left, however, the Bolick appointment is frightening. On ThinkProgress, Ian Millhiser calls it The Most Chilling Political Appointment That Youâve Never Heard Of.
What disturbs Millhiser is that, he writes, Bolick has spent the last quarter century working to make the law more friendly to anti-government conservatives."

I’ve been aware of some of (now) Judge Bolick’s work over the past couple of decades.
Glad he is in a position where he can have a major influence on issues like this.
Hopefully a future U.S. Supreme Court Justice.
This is an incredibly bold pick. Surprised the heck out of me while delighting me.
It says a lot about Governor Ducey.
