I don’t have an issue with Cruz’s eligibility, if that’s what you’re asking.

If you’re asking why I think this is unsettled law, then I’d refer you to the State Department’s Foreign Affairs policy manual (and the comments by many conservative pundits and scholars) that specifically state that SCOTUS has never ruled definitively on whether or not a statutory citizen-at-birth is a natural-born citizen and eligible to the presidency.

No premise in law is left in question for SCOTUS to rule.

That would be legislation by the bench.

The court is not required to weigh in on anything, and congress has the power to limit court jurisdiction.
