In my vernacular, if circumstnaces of his birth meet the statutory requirements, then he IS a citizen, before he presents himself to the examiner. Your position is that he is not a citizen until the examiner says so.

Precisely correct. Until you prove that you are eligible, you are not a citizen. Cruz was a Canadian citizen without any conditions.
You do realize that Cruz had the option of not applying for US citizenship.
