DOJ finalizing rule change for Trusts, LLC and Corporation's (watch silencer sales soar)

"The Department of Justice is planning to finalize a proposed rule to amend the regulations of the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) regarding the making or transferring of a firearm under the National Firearms Act. As proposed, the rule would; (1) add a definition for the term "responsible person"; (2) require each responsible person of a corporation, trust or legal entity to complete a specified form, and to submit photographs and fingerprints; and (3) modify the requirements regarding the certificate of the chief law enforcement officer (CLEO)".

The short answer is yes. The easiest place to find the best answers on NFA purchases and acquisitions is with a reputable NFA dealer. Go in and ask - they do this for a living and much of what I read online is contradictory.

The pain in the butt is the wait for approval from NFA - the paperwork is not too obnoxious.

I think the only change is that each person listed on the trust (or corporation) is now subject to a background check. The objective seems to be making sure a prohibited person is not a member of the trust?

It sure sounds like there will be no way of buying a suppressor without a CLEO signature even with a trust.

There was some talk that they were doing away with that requirement? There are some chief law enforcement officers that refuse to sign off on anything and it has caused issues because the applicant has a right to appeal based on a blanket policy by an elected or appointed official. If a background check is done at the time of transfer it’s kind of pointless. The intent of that when the law was enacted relied on the knowledge of the Sheriff or Police Chief about a particular subject. That is rather archaic today because it is doubtful they personally know more than a handful of people applying.

A couple of years ago it took me 8 months to get a stamp for a suppressor... It wouldn’t surprise me a bit for the Obummer crew to run out the clock so that the upcoming surge of applicants do not make it out of the gate before the new rules go into effect.

Wouldn’t be hard. He’d just order ATF to cut funding for processing staff so they’d have only one guy running the paperwork.
