I am amazed at the number of FReepers who won’t read the caption under the video, or try to get more information.
The caption under the video says the officer claims it was an accidental discharge. So yes, it was a bad shooting, but it wasn’t premeditated murder.
Unfortunately the LAW is clear on this, when HE REMOVED his gun from the Holster, INTENT WAS ESTABLISHED, An Accident is IMPOSSIBLE AT THIS POINT.
Now if it went off while it was in his holster, you would have a valid point.

I almost forgot, The Perp clearly radios in and tells dispatch that the Driver is REFUSING TO EXIT THE VEHICLE without bothering to mention that he Just MURDERED HIM IN COLD BLOOD!

You don’t put your finger on the trigger unless you INTEND to shoot! It takes only a split second to move your finger from the side of the weapon to the trigger! This is an intentional act, and as several have said ATTEMPTED MURDER under color of authority.
