That’s to make sure he is not going to shoot them from the ground.
There is a still photo out showing the guy still holding the gun in the upright position while still on the ground. He was not giving up the pistol. The guy was probably high on something.

While he was still in possession of the GUN, of course. How this can be considered a “bad shoot” is beyond me. I’m guessing the neighborhood is at least “mixed”. There were clerks and customers at the gas station. Don’t their lives matter? I’d love to know what their opinion of this event is. I’ll bet they aren’t saying anything except “thank you” privately to the police.
