I disagree, if they can show that the food delivered is at a substandard level to what they serve at the restaurant, I believe that they would have a very good argument that their brand was being damaged.

A quibble: Tommy's doesn't need to actually show substandard service, it just needs to refuse to take the chance it might be.

any food product gets cooled off when delivered

unless they can show there’s some deliberate damage (very very unlikely).... it would appear they have no case

they lose all rights to the product when they sell it

it is not theirs anymore, they have no further say

now, if the private delivery were to appropriate their trade mark logos, then that would be actionable

just my 2 cents worth, for free too!
so its worth at least as much as you paid for it

ps: a major portion of taxicab revenues are delivering grub like this (and booze) to residences....same idea...nothing new now that i have heard anyways
