I believe this is a poorly written article. My understanding of the executive order in question is that, in addition to exercising “prosecutorial discretion” on enforcement of immigration law (which as you pointed out he can easily do at any time), he was also going to start issuing work permits for illegals for whom he was choosing not to enforce the law. This, I believe, is what the states sued to prevent, and what the court injunction is all about.
