They don't. Even if they wanted to it would be Obama's DOJ that would need to bring charges against her and they surely wouldn't. The gun running to Al Queda ordered by Obama would be exposed at that point and Obama will not allow that to happen.... Ever.
She's in the clear and if not stopped she might skate all the way to the white house. At that point, it's game over.

That may not even come out- she alone, without any charges on gun running, has committed, according to rudy gulianne, 16 separate crimes such as obstruction, tampering with evidence etc (He has them listed somewhere- and all are unrelated to the gun running issue)
Dear leader may very well throw her under the bus- hoping to stop the investigation from going any further
