You guys will never learn. You always think you can sway the power of big government to work for you if only you get your hands on the levers of power. It never ends well. The solution is to get rid of big government root and branch. There is no need for the Dept of Education in the first place. Get rid of it, period. Education will do just fine without it. You are correct, but you are focusing on a triviality. Allowing the condition of only left wing thought in the Universities is sowing the wind for which we shall and are currently, reaping the whirlwind.
Something must be done about it, and it matters not to me if you call the people doing something about it the "Department of Education" or something else.
The current conditions in Academia are akin to deliberate discrimination against religion and creed. Indeed, they are very close to being exactly that.
So we use the Justice Department. I don't care who the goons are. I just care that we get some goons out there to give them a taste of their own medicine.
