Perhaps they left out the “is” as newspapers often do to save space in the headline.

Here is what I am thinking will happen:

FBI turns in a report, recommending charges. DOJ sits on it and refuses to prosecute. People within DOJ or FBI leak the report/recommendations. Then things really would get interesting.
