Kansas is very squeamish regarding the death penalty. BTK only got a hard 40 or 80 depending on who you talk to, but folks who have been there say he’s a pampered pet with his own computer even.

It’s common for death penalty cases to appeal to the supreme court as a last final appeal to overturn their sentences. I know personally of two others that were turned down...one of them at least by a judge I least expected to turn it down.
