FACT: Heroin use/possession is a crime.
FACT: Alcohol consumption/possession is not a crime.
A while back a guy plied a small child with liquor so he could put the moves on the child's mom, and the child died; was that child a "victim" of the legality of alcohol? To me the answer is clearly "no".
