What China considers to be its “territorial waters” are in reality international waters under centuries-old customary international law.

And that definition also applies to the Bering Sea, does it not?

Yes, absolutely. But that doesn’t describe the situation we are talking about. The U.S. is not claiming the international waters of the Bering Sea as its territorial waters. China however, is claiming the international waters of the South China Sea as its territorial waters. The moral equivalence argument does not work here.
