Appeals court rules two bikers were jailed with sufficient probable cause.

In an opinion released Thursday, Justice Rex Davis of the 10th Court of Appeals declared that officials had sufficient probable cause to arrest two bikers after the May 17 Twin Peaks shootout in Waco.

The melee killed nine men and injured another 20, resulting in the arrest of 177 bikers, each initially held on controversial $1 million bonds on a charge of engaging in organized criminal activity.

Final autopsy reports were released last week on the nine killed in the melee, but ballistics evidence remains publicly unavailable, pending the completion of an investigation headed by the Bureau of Alcohol, Tobacco, Firearms and Explosives.

Both bikers involved in the ruling, Marcus Pilkington, 36, of Mexia, and Reginald Weathers, 43, of Forney, are represented by Austin attorney Adam Reposa.

Pilkington and Weathers filed applications asserting that they “were being illegally confined” and that officials lacked probable cause that the two were guilty of engaging in organized criminal activity that day.

Thursday’s ruling cites a section of the Texas Penal Code which states that a person commits the offense if, “with intent to establish, maintain, or participate in a combination or in the profits of combination or as a member of a criminal street gang, the person commits or conspires to commit one or more of the following: murder, capital murder ... (or) aggravated assault.”

LOL! JC was NOT a nuclear engineer. He was a USNA graduate that went into the early Navy nuclear program.

Carter was NEVER a nuclear engineer. His last duty was “under instruction to become an engineering officer”.

He never served as an engineer and never served aboard a nuclear powered ship.

After a ‘non-career’ in the Navy, he went back to being a farmer.

I just happen to have a little time this morning to rag on you. I'm sure it is not news to you that I find your posts worse than useless, and a distraction at best. Yeah, looks like a bunch of empty quibbling quarrels.

It could take eons in internet time until everything about this row become “official” — and the sad story of the Hillary Clintons of this world shows us that even sins of the obvious (like playing fast and loose with classified information on a private computer) can be “officially denied.”

I would not be surprised at all to find that sunshine eventually reveals the presence of poxes on “both houses.” Nobody is sporting simon pure halos in this story. But one thing, it doesn’t sounds like it has made nearly the dent in “outlaw bikerdom” that it has been cracked up to.

Nuclear engineers in the Navy never needed to do it “aboard a nuclear powered ship.” They had land support.

Carter never made Engineer.

Carter never made it to a nuclear powered ship.

The most Carter ever did was ‘assist’ with some training programs.

That's not what I said, and your restatement of my remarks is another example of how you intentionally mislead. What I said @78 was "Her posts are usually but not always technically correct, and usually but not always misleading."
