Retired Bosque County judge to hear bikers’ examining trials [Waco]
Waco Herald-Tribune ^ | August 3, 2015 | TOMMY WITHERSPOON

Posted on 08/03/2015 5:11:31 PM PDT by don-o

A retired state district judge from Bosque County was appointed Monday to preside over the examining trial of a Hewitt biker — and potentially 19 others — arrested in the May 17 Twin Peaks shootout.

Judge Billy Ray Stubblefield, administrative judge of the 26-county 3rd Judicial Region, confirmed Monday that he appointed Judge James Morgan to preside over the examining trial of Hewitt resident Matthew Clendennen, which is set for Aug. 10.

Stubblefield said his order also gives Morgan authority to hear any of the 19 other cases involving bikers seeking examining trials to challenge whether there was sufficient probable cause for their arrests after the shootout that left nine dead and 20 wounded.

The judicial appointment became necessary after senior Judge Joe Carroll, of Bell County, recused McLennan County Justice of the Peace W.H. “Pete” Peterson two weeks ago from presiding over Clendennen’s examining trial.

One other biker, Drew David King, of Dripping Springs, also has filed a motion to recuse Peterson, and Peterson said Monday he will allow Morgan to hear King’s case.

Peterson said he is planning to preside over the 16 other examining trials that are scheduled for his court unless any of the parties in those other cases object or file motions to recuse.

Justice of the Peace David Pareya, of West, has two examining trials set in his court and Waco Municipal Judge Chris Taylor has one set.

Clendennen’s attorney, Clint Broden, of Dallas, complained in his motion to recuse Peterson that the former Department of Public Safety trooper set unreasonably high bonds and said he was doing so to “send a message” about the gravity of the incident. He also complained that Peterson signed off on what Broden and others have called “cookie-cutter, fill-in-the-blank warrants” for the arrests of 177 bikers on identical engaging in organized crime charges.

Only three of the 177 bikers arrested remain jailed, and they have charges from other counties pending.

Besides Clendennen and King, the bikers who have requested examining trials include: Daniel Pesina, San Antonio; Mitchell Bradford, Gordon; Juventino H. Montellano, San Antonio; Joseph Ortiz, San Antonio; Richard R. Donias, San Antonio; Lawrence Garcia, San Antonio; John Guerrero, San Antonio; and Tom M. Mendez, San Antonio.

Also, John R. Wilson, Waco; Clayton D. Reed, Burleson; Matthew R. Folse, Dallas; Morgan J. English, Brenham; William H. English, Brenham; James A. Venable Jr., Mart; Royce Van Vleck, San Antonio; William C. Aikin, Talco; Jimmy Lee Pond, Austin; and Thomas P. Landers, Georgetown.

Where the hell did you learn English?

A talking brainstem is an unusual phenomenon. Enjoy it for what it is.

O.K then.

What’s your over/under on the number of 177 criminal bikers serving any jail time? After the disposition of all cases how many actually serve 1 day of jail time?

I’m at 5 or less. That’s about 3%. If 5 serve time.

“It turns out that those five were Vietnam Veteran riders. “ - JJF

I would like to see the report on being Viet Nam Vets. Where did you get that bit of info?

TIA

The story is about 1/3 of the way down. You’ll see a picture with a big white arrow in the middle of it indicating Vietnam Vets back patches.

I’d say 25%, possibly more.

There may not have been more than 10 to 15 ‘shooters’, but very likely many more will do time for violation of probation/parole, illegal possession of a gun, possession of some drug or wants and warrants.

These “Cracka Crips n Bloods” got way too big for their britches.

Texas and Waco was tired of messing with these gang jerks, why/ because the citizens were tired of them. A whole of people here take Don’t Mess With Texas very seriously, not as just some litter slogan.

So even you are saying that 75% of those arrested were arrested for nothing? And that doesn’t trouble you in the least?

I’m still sticking with my 5 figure. And that means doing jail time not pleading to a misdemeanor. I mean, when you are held on a $1,000,000 bond you would expect at least a little jail time wouldn’t you?

Oh, I understood you well enough. I was just wondering what your native language is.

(BTW, ‘ignorant’ is neither a nationality nor a language)

Pardon my butting in, but I suspect the contention is that 75% SHOULD be convicted, but won't be due to weakness in the law. The contention is that ALL of them should be arrested, but 25% or more will be convicted of a crime.

No, butt in anytime you like. I appreciate your contribution.

The contention is that I’m saying maybe 5 of 177 serve 1 day or more in jail after conviction. the “other side” say’s 75% will do jail time. I wasn’t vague on that assertion. At all. Should, Could, Would, May be etc.

I said would. I see a bet in the future.

Crap. No 25% would be convicted. I was asking if 75% being wrongfully arrested would be O.K.

You guys need to take off the rose colored biker glasses.

Never said 75% were innocent. They were obviously arrested for suspicion. Most of that 75% have already or may be cleared of the murder part, but many of the 75% could be facing other ‘non-capital’ charges.

I predict that at minimum 5 will face the death penalty, the remainder of the 25% lesser than aggravated murder charges, which will result in prison.

As a result of the criminal bikers long history of bad behavior, they will likely be facing less than sympathetic juries.

You said 25% would do jail time. I said 5 or less which is less than 3%.

My point was that if you hold 177 people on $1,000,000 bond you would expect quite a few to do prison time. Otherwise, it just looks like they arrested and held people for no reason.

25% is 44 people doing time. We’ll see.
And we’ll also see how much money is paid out to how many that were arrested. If they were arrested legally then there shouldn’t be any payouts, should there?

I’m not interested in your homosexual recruiting. Stick to hanging out in gay bars and don’t bother us normal folks.

Yep, we’ll see.

Suspecting that once the juries start coming in with lots of convictions, 99% of the FR criminal bike gang groupies will be silent as lambs.

Dude you guys are the ones pulling down your pants, bending over grabbing your ankles for these criminal bike gangs. Don’t know if we should call that queer or just the Prison Dating System.
