Does that apply to recording in a public place such as the restaurant in the first video? You need consent if the other party has reasonable expectation of privacy. Not sure how that would shake out in the restaurant setting... it would probably be up to a jury to decide after weighing factors like how close other patrons are, restaurant help, etc.
