Yeah, the gay marriage case was exactly about the rights of the state to determine marriage.

Marriage isn’t named in the constitution which makes it a clear state issue but the supreme court ruled it legal in all 50 states anyway.

Its why I support the Ted Cruz idea of retention elections for Supreme Court justices. I would let the state legislatures vote on them to return power to the states. The court wouldn’t be so quick to step on the states if the states held their fate in their hands.

We've had that since we eliminated prayer though, and since the Roe decision. In Roe Blackmun & co. had to squint their eyes just right to just barely make out the imaginary "penumbra" granting a woman the right to hire a serial killer to dismember her baby.
