The prime difference that it could make is if a Republican wins the Presidency and then tries to get his judicial appointments to be brought up through the committees. If the Dems control the Senate, his nominations will languish. If the Republicans control the Senate, the judges can maybe be confirmed 51-49. Harry Reid sat on George Bush’s judicial nominees during the last 2 years of Bush’s presidency. Controlling the Senate would make a HUGE difference in appointing justices.
