The SCOTUS will rule that states that did not create a state exchange delegated their authority to the Federal Exchange.
Thomas, Scalia, and Alito will dissent. Roberts will vote with the majority.

I would hope that a delegation of authority is an affirmative action, not a default position based on inaction. A state cannot have its authority taken away because it chooses to not do something.

That's like saying that the president can recess Congress to make recess appointments because Congress chose not to recess.
