Congress moving to block EPA regulation of streams, wetlands

Congressional Republicans are pushing to block an Obama administration rule designed to protect water quality in small streams, tributaries and wetlands before it goes into effect later this year.

The Senate Environment and Public Works Committee approved legislation Wednesday that would force the Environmental Protection Agency and the U.S. Army Corps of Engineers to withdraw and rewrite rules issued in May that clarify which of those smaller bodies of water are regulated under the Clean Water Act. The EPA says the rule will protect the waters from pollution and development and safeguard drinking water for 117 million Americans.

Republicans in Congress say the rules are federal overreach, would expand current law and could be a costly and confusing burden for landowners and farmers. The House passed a bill last month that would also block the rules—legislation the White House threatened to veto. House Speaker John Boehner, R-Ohio, has called the rule “a raw and tyrannical power grab.” …

Nonsense, 117 million Americans? Prove it, in what state, in what cities, along what “waterways” the EPA deems it should oversee. Please give me the specifics. Despite the fact Congress created this executive agency, the EPA does not have the power to create laws, even when they are called “regulations,” which are simply laws by another word. Only the legislative branch can make laws, at least as far as the Constitution is concerned.

Actually, Nixon created the EPA by executive order (called “Reorganization Plan No. 3”; very communist-sounding), although he did get approval from Congress; it was his proposal. The regulations they write and enforce are ostensibly based on laws Congress passes.

By “ostensibly” I meant that the EPA claims to base all of its regulations on laws passed by Congress, but that does not necessarily mean it is so.

And no, the EPA is not valid whatsoever, any more than his other left-wing-based “reforms”.

All these agencies originating in the late ‘60s and ‘70s should be abolished. Anyone who was alive then remembers they were all pretty much created to “shut the hippies up.” That hardly seems a good reason to keep them going.

Only because it will affect them directly. It would affect their pools and nice golf course lawns plus their vacation homes afraid that the regulations might restrict their water usage and raise its cost.
