Initial statements, before a witness has had a chance to recant due to peer pressure, can be most credible. Also, even if a witness can hear but not see, the hearing is likely to be enough if a beating was going on. If there was anyone else in the van with Gray, the witness who could not see him would surely be able to hear him saying something like, “Stop beating me!”
