Officer requests to see knife as part of defense in Freddie Gray case

A defense attorney for one of the six police officers charged in the death of Freddie Gray is challenging prosecutors' claim that Gray was falsely arrested, and filed a motion Tuesday demanding to inspect the knife Gray carried.

The motion was the first legal move in defense of an officer involved in the April 12 arrest of Gray, who died a week later from spinal injuries suffered while in police custody.

As potential legal arguments for the six began to emerge, legal analysts debated the merit of the specific charges, as well as the strategies defense attorneys might pursue.

Marc L. Zayon, the attorney for Baltimore officer Edward Nero, asked a judge to make the Baltimore state's attorney's office and Baltimore police turn over the blue pocket knife Gray carried to determine whether it's legal in the city of Baltimore. The knife was found clipped to the inside of Gray's pants pockets after officers took him down.

Police say the officers chased and arrested Gray because he ran from them without being spoken to or provoked. A police task force continues to investigate whether any other reasons could have contributed to their decision to stop him.

Gray was charged with carrying an illegal knife, but Baltimore State's Attorney Marilyn J. Mosby said Friday in announcing the charges that the knife Gray carried was not an illegal switchblade under Maryland law. Baltimore police have said the knife violates city code. . .

Hope the defense has something to ascertain the knife in evidence is actually the knife Freddie Gray was packing and not some look-alike penknife substituted by the D.A.

There is so much more to this incident that is being swept under the rug of political expediency that it makes you wonder just who is in charge, the DA, the DOJ or Val. Jar.? Certainly not B.O. himself as he is too busy pondering whether or not the people who actually claimed responsibility for the terrorist attack in Texas actually are terrorists and actually did what they claimed they did. God save the Republic.

The Baltimore mayor, her administration (including her Police Chief) and the DA have gone full criminal enterprise and are uniting with Obama’s Department of Injustice in their attempt to pervert this so called “case” to fit their narrative. I no longer would be surprised for them to engage in evidence tampering.

This case is sop messed up. Avoiding cops isn’t an offense. They had no reason to arrest him, much less even talk to him. Carrying a knife (any kind of knife) shouldn’t be illegal. (Knife was found later, not part of the initial stop.) That said, him ending up dead after they failed to maintain certain policies regarding prisoner transport is what’s going to hurt the cops. Yes, other guys say Gray was going crazy in the van, but the failure to restrain/seatbelt him in is going to be an issue I’m sure.

I said this on a post yesterday and some one said the knife should have been photographed as evidence when the cops got to the station.will see if they screwed up.
That doesn’t let the van driver off the hook..I think he screwed up ,

The idea of seeking justice has been sacrificed to advancement of the leftist agenda.

If evidence tampering did take place and a different knife was substituted who could refute it?

Wouldn't that likely require the testimony of one of the defendants who had actually handled and operated the knife and made the determination it was illegal?

My thoughts are, what is to stop the Baltimore State's Attorney office from pulling the old switcharoo? Not a damn thing. Higher city officials? You gotta be kidding me.

False.

The suspect was a known repeat drug offender in an area known for drug activity, whose suspicious behavior (including running) gave police reason to detain him (see Terry stop ). During the stop and frisk the knife was found leading to the suspects arrest. All proper and legal under Baltimore & Maryland law.

There is an audio recording at theconservativetreehouse.com that proves that medical assistance was requested during transport and that the officers were coordinating between dispatch and the EMT’s to intercept assistance enroute.

This completely blows the charges of negligent homicide out of the water.

Maybe not, but in Baltimore some are, apparently. It looks like the prosecutor may not know this yet. She will before its over.
