A federal judge denied the federal government's request to lift a hold on President Obama's controversial immigration actions in an opinion released Tuesday night.
Judge Andrew Hanen wrote that the government misled the court by revealing last month it had granted expanded work permit renewals to 100,000 illegal immigrants before the court blocked the administration from implementing its new policies.
ADVERTISEMENT He added a new hearing in March only reinforced his February decision to issue a stay to block those new policies, meant to delay deportations for millions of undocumented immigrants and provide them with the opportunity to apply for work permits.
It is obvious that there is no pressing, emergent need for this program, he wrote as part of the rationale for not allowing the administration to immediately implement its new policies.
A group of more than 20 states has challenged the presidents immigration actions as an executive overreach. Hanen ruled in February the courts should decide the constitutionality of the policies before implementation.
The federal government had contended the Texas district court judge didnt have the jurisdiction to block all of the policies, just the ones that impact Texas, essentially creating different immigration standards for the interim. But Hanen dismissed that argument as inconsistent with the Constitution, which calls for uniform immigration laws.

What I loved was the Judge throwing Obama’s own words back at him. He cited Obama telling a Hispanic organization that if the Border Patrol folks did not comply with his orders there would be “consequences”. The judge stated that that statement made it abundantly clear that there is no “discretion” allowed by the agents for deportation of illegal aliens under current immigration laws. The judge made clear that DHS is required to post the new DAPA and revised DACA policy in the Federal Register under the APA, thus requiring a comment period for the public to make their views known.
What a slam to the Administration.Read the decision. It is a good read, and not long.

The 5th Circuit Court of Appeals today denied the Obama Administration’s request for an expedited ruling on Judge Andrew Hanens injunction blocking President Obama’s executive amnesties.
Justice Department attorneys asked the court to rule within bseven days but the court allowed the normal 10-day period for states to respond to the Administration’s request. Politico reports this could be an early sign that the 5th Circuit may not want to overturn Judge Hanens injunction quickly.</b>
It looks like it is being called “expediting” in the one article when it is actually just the opposite. They are adhering to the 10 days Judge Hanen gave the states to reply. Furthermore....if Judge Hanen goes for discovery we have quite an interesting case!
Remember “Ike,” our President after WWII? He used ships, boats, buses, airplanes to deport all illegals while he was our President. Bless Judge Hanen, but we know our government is not going to actively deport anyone.
I throw this out to you all....There are approximately 20 million illegals currently in the U.S. That being said, it would only take 5 to 10 million private citizens’ cars, along with a BP, Homeland Security, or ICE agent accompanying, for us to personally deport this scum who have invaded our country.
My car will hold one BP agent and two or three illegal scum, along with myself, and I will buy my own gas to get these people out of our country. (Cheap at half price compared to the taxes we are paying to take care of the scum.)
Any chance we could get some caravans headed to the southern border, say to Laredo or Eagle Pass or Sierra Blanca where they can walk across back to their homes?
We only need approximately 10 million patriots who have automobiles and the where-with-all to purchase their own gas.
I live along the northern border, so I estimate the trip will take three to four days to reach the southern border while traveling only during the day. If we could have two drivers in each vehicle, we could travel 24 hours a day and get them “home” sooner.
