Those are judgements that the court seems to have left in the hands of the schools to decide.

No, not unless you are an administrator at UC Berkeley. Also, the rules are a bit different for universities, I believe.

Yes, we're legitimizing the rabble rousers, and putting fear into those who wish to express patriotic sentiments.

It is not up to the individual to stifle thought and speech; it is up to the individual to show proper behavior and restraint towards others when in public engaging with others.

Right...but the problem with the stifling of it here is the flag of our country. It presupposes that it is a negative to have it present when its very presence to wave or be burned has been upheld time and again.

This is a very bad decision for several reasons and I wonder which justice it came before because I guarantee you it was not Scalia, Thomas or Alito...If they did I would dam well want to know why!

The court really has no place to intervene in this though I fully supported the students who wore the flag tshirts. The proper place for this to be resolved is at the state level. However what makes this stance a bit problematic is that the Federal Courts have involved themselves in this before.

So by refusing to intervene the justices are in effect letting previous precedent stand which I personally believe is unjustified.

One way to handle this in CA is they could actually get a state constitutional amendment on ballot to protect displays of the flag and even there it probably would pass easily.

If there will be a counter protest on cinco de may 5th, I’d love to bring and wear a ‘Merican (American}flag shirt. Dam right, we don’t celebrate May Day here at the schools.

Seal the boder and deport them ALL, have the balls to do the right thing, sure you might have to clean your own hose or cut your on lawn. Just look at the $$$ you will save in taxes not having text books, voter ballots and drivers license booklets printed in 38 different languages.

There is already Supreme Court precedent (Tinker vs. Des Moines Independent School District, 1969) that says public schools can stifle students’ speech, if it is disruptive or causes disorder.

The problem with it is that it is used by Leftist school "authorities to stifle the free and peaceful speech of those who love America and to foster the will of the illegals who hate everything about America. When the display of our Nation's flag becomes "disruptive" or makes the person displaying it an "agitator" something has gone seriously amiss.

I would like to see all the patriotic kids at all schools display the American Flag and let the Leftists try to keep them kicked out in favor of the real agitators - might make an interesting first coffee news break...
